IMPORTANT: Please read these Terms of Service carefully before using DebtTrack. By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree, do not use the service.

1. Acceptance of Terms

By accessing, browsing, or using De btTrack ("Service", "App", "Platform", "we", "us", "our"), you ("User", "you", "your") agree to comply with and be bound by these Terms of Service and all applicable laws and regulations. Your continued use of the Service constitutes your ongoing acceptance of these terms and any future modifications.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

2. Description of Service

DebtTrack is a personal financial tracking application designed to help individuals monitor and manage informal debts, loans, and personal transactions with contacts. The Service includes:

  • Real-time transaction recording and tracking across multiple currencies
  • Contact management and debt ledger visualization
  • Payment profile storage for sharing payment information with linked contacts
  • Progressive Web App (PWA) functionality for offline access and cross-device synchronization
  • Optional account linking between users for two-way transaction visibility
  • Dashboard analytics and reporting features

The Service is provided for personal, non-commercial use only. DebtTrack is NOT a financial institution, payment processor, credit bureau, legal service, collection agency, or professional financial advisor.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Create a secure password and keep it confidential
  • Accept full responsibility for all activities under your account

3.2 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities and transactions that occur under your account
  • Immediately notifying us of any unauthorized access or security breach
  • Ensuring your account is not accessed by unauthorized third parties

We are not liable for any loss or damage arising from your failure to maintain account security. We reserve the right to suspend or terminate accounts that we believe have been compromised.

4. Acceptable Use Policy

4.1 Permitted Use

You may use DebtTrack solely for:

  • Personal financial record-keeping and debt tracking
  • Managing informal loans and transactions with individuals you know
  • Storing payment information for your own organizational purposes
  • Communicating with linked contacts about shared financial records

4.2 Prohibited Activities

You explicitly agree NOT to:

  • Use the Service for any illegal, fraudulent, or unauthorized purpose
  • Violate any applicable local, state, national, or international law
  • Track debts related to illegal activities or illicit transactions
  • Harass, threaten, defame, or violate the rights of others
  • Upload, transmit, or distribute malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated scripts, bots, or scrapers to access or interact with the Service
  • Interfere with or disrupt the Service, servers, or networks
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or store personal data about other users without consent
  • Use the Service for commercial debt collection purposes
  • Sell, rent, lease, or sublicense your account to third parties
  • Share your account credentials with others
  • Create multiple accounts to abuse the Service or circumvent restrictions

5. Payment Profile Feature - Important Disclaimers

5.1 Nature of Payment Profiles

The payment profile feature allows you to store and share payment information (bank accounts, mobile money details, reference codes) with linked contacts. This feature is for informational purposes only.

5.2 No Payment Processing

DebtTrack does NOT:

  • Process, facilitate, or execute any financial transactions or payments
  • Hold, transfer, or manage funds on your behalf
  • Act as a payment gateway, processor, or intermediary
  • Verify the accuracy or validity of payment information
  • Guarantee that payments will be made or received
  • mediate disputes related to payments or debts

5.3 User Responsibilities

YOU are responsible for:

  • Verifying the accuracy of all payment information you enter
  • Ensuring payment details are up-to-date and valid
  • Conducting all financial transactions outside of the DebtTrack platform
  • Complying with all applicable financial regulations and tax obligations
  • Protecting sensitive financial information from unauthorized access
  • Understanding the risks of sharing payment information with others

5.4 Security and Privacy Risks

By using the payment profile feature, you acknowledge and accept the following risks:

  • Payment information may be viewed by linked contacts
  • We cannot control how recipients use your shared payment information
  • There is a risk of fraud, identity theft, or unauthorized transactions
  • Payment details could be exposed in the event of a data breach
  • Third parties may attempt to exploit shared payment information
  • We are not responsible for losses resulting from misuse of payment data

6. Data Accuracy and User Content

6.1 No Verification

DebtTrack does not verify, audit, or validate the accuracy of:

  • Transaction amounts, dates, or descriptions you record
  • Contact names, email addresses, or phone numbers
  • Payment information including account numbers and reference codes
  • Currency conversions or exchange rate calculations
  • Balance calculations or debt reconciliation

6.2 User-Generated Content

You are solely responsible for all data, information, and content you input into the Service. We do not endorse, guarantee, or assume responsibility for the accuracy, completeness, legality, or reliability of any user-generated content.

7. Privacy and Data Protection

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

We employ industry-standard security measures, but no system is completely secure. You acknowledge that data transmission over the internet carries inherent risks, including potential interception, unauthorized access, or data breaches.

8. Intellectual Property Rights

8.1 Ownership

All rights, title, and interest in and to the Service, including all software, code, design, graphics, text, logos, and trademarks, are owned by or licensed to DebtTrack. The Service is protected by copyright, trademark, patent, and other intellectual property laws.

  • Google OAuth authentication services

  • Currency exchange rate APIs
  • Payment processing platforms (for informational purposes only)

We do not control, endorse, or assume responsibility for any third-party content, services, or websites. Your interactions with third parties are solely between you and the third party. You acknowledge and agree that we are not liable for any loss or damage resulting from your use of third-party services.

10. Disclaimers and Warranties

CRITICAL DISCLAIMER: THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding the accuracy, reliability, completeness, or timeliness of content
  • Warranties that the Service will be uninterrupted, secure, or error-free

MAXIMUM LIABILITY NOTICE: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEBTTRACK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER.

IN NO EVENT SHALL WE BE LIABLE FOR ANY:

  • Direct, indirect, incidental, special, consequential, or exemplary damages
  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or alteration of your data
  • Damages resulting from data breaches, security incidents, or system failures
  • Damages resulting from errors, mistakes, or inaccuracies in content or data
  • Personal injury or property damage resulting from use of the Service
  • Damages resulting from third-party conduct or content
  • Financial losses resulting from reliance on the Service for debt management
  • Damages resulting from misuse of payment information or financial fraud

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH YOUR CLAIM IS BASED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH THE SERVICE OR THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.

You agree to indemnify, defend, and hold harmless DebtTrack, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

13. Account Termination and Suspension

13.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature within the app. Upon termination, your right to access and use the Service immediately ceases.

13.2 Termination by Us

We reserve the right to suspend, restrict, or terminate your access to the Service at any time, with or without cause, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Suspected fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Technical or security reasons
  • Requests by law enforcement or government agencies
  • Discontinuation of the Service (in whole or in part)

13.3 Effects of Termination

Upon termination or suspension:

  • Your license to use the Service immediately terminates
  • We may delete your account and all associated data
  • We are not obligated to retain, provide, or return any of your content
  • All provisions of these Terms that should reasonably survive shall survive

We recommend regularly backing up or exporting your data. We are not liable for any loss of data resulting from account termination.

14. Financial and Legal Disclaimers

14.1 Not Financial Advice

DebtTrack does not provide financial, legal, tax, or accounting advice. The Service is a tool for personal record-keeping only. Any information provided through the Service is for informational purposes and should not be construed as professional advice.

14.2 No Legal Enforcement

DebtTrack records are not legal documents and cannot be used to legally enforce debts or obligations. We make no representations about the admissibility of Service records in legal proceedings. Consult a qualified attorney for legal advice regarding debt collection or disputes.

14.3 Tax Implications

You are solely responsible for determining and complying with all tax obligations arising from loans, gifts, or transactions tracked in the Service. We do not provide tax advice or reporting services.

15. Modifications to Terms and Service

15.1 Changes to Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes will become effective immediately upon posting to the Service or our website. We will update the "Last Updated" date at the top of this document.

Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the new Terms, you must stop using the Service.

15.2 Changes to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, including but not limited to features, functionality, content, availability, or pricing. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DebtTrack operates, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of competent jurisdiction in that location, and you consent to personal jurisdiction and venue in such courts.

17. Dispute Resolution

17.1 Informal Negotiation

In the event of any dispute, claim, or controversy, you agree to first contact us at debttrackpro@gmail.com to attempt to resolve the matter informally.

17.2 Arbitration

If informal negotiation fails, disputes may be resolved through binding arbitration in accordance with the rules of the jurisdiction's arbitration association. The arbitration shall be conducted in the English language. You waive your right to participate in class actions or class arbitrations.

18. General Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy and any supplemental agreements, constitute the entire agreement between you and DebtTrack regarding use of the Service and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

18.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
